Terms of Trade
Podcast production is subject to the following terms between DustPod and Client whose name and address is stated on the invoice, payment of which constitutes acceptance of the terms.
1. Production & Scope
DustPod shall produce podcasts as specified on invoice. Service is provided on a fair-use basis. Should a project significantly exceed production allocation, any additional work will be agreed upon in advance with Client.
2. Editorial Control & Revisions
Client has editorial control with instructions given at the following stages:
– During or at the immediate end of a recording.
– For content edits a transcript will be provided and cuts made according to Client instructions.
– One set of consolidated revisions per episode requested in a single email within seven days of delivery.
Changes after these stages are billed at DustPod standard hourly rate.
3. Service and Cancellations
Service is invoiced on a retainer basis for the period stated on the invoice. Unused hours or episodes do not roll over. Cancellations within 48 hours of a scheduled recording incur a fee equal to one hour of DustPod standard rate. DustPod standard rate is €175.00 + VAT.
4. Copyright & Credits
Copyright in the delivered Podcast rests with the Client. Music cues/IDs are licensed for use within the delivered podcast only. DustPod includes a production credit in each episode as an accountability mark and is removable on request.
5. Hosting
DustPod will host published files during the service period, and on completion, until the end of the prevailing calendar year. For subsequent years a hosting fee of €250 applies per annum. Alternatively, the Client may move files to their own server at any time; DustPod will provide RSS feeds and metadata to facilitate the move.
6. Payments & Collection
Invoices are due within 30 days. Accounts outstanding after 90 days will be surrendered to a Credit Control company. Client is responsible for all liabilities, including legal and collection costs incurred in recovering money owed.
7. Confidentiality & Law
Both parties shall treat all business methods and intentions as confidential. These terms are governed by Irish Law and the Courts of the Republic of Ireland. Failure to enforce any specific term does not mean a general waiver of those terms. If any part of these terms is found to be invalid, the remainder of the agreement remains in effect.
